First, that appears to be a Piper Saratoga with the high performance package (the same type of aircraft which JFK Jr, and his family perished in). They suck fuel down like there's  no tomorrow - which means that a legitimate pilot would never fly one on "fumes". The FAA would have also gotten involved.

Secondly, if someone would place an opened beer can, or any beverage can on the wing of my Piper Aztec, they would be headed to the proctologist, for removal of the can - from a sideways position.  Never, ever, should anything be placed on a wing which has the potential to dent it, or leak fluids other than water into/onto the control surfaces.

Thirdly, when pushing an aircraft, the flaps must be in the downward position, to prevent damage to the trailing edge of the control surface.

Why would a legitimate pilot allow them to drink in, on, or around the aircraft that he or she is charged with the operation and care of??
